General Terms for Issuing and Using Vortal Digital Certificates
1 – Digital certificates issued by VORTAL enable the issued party to be identified when using VORTAL electronic platforms and are for the exclusive use of the same.
2- Digital certificates issued by VORTAL identify a specific person as the authorized representative of a particular registered company to the effect of using VORTAL electronic platforms;
Equally, VORTAL:
a) in the procedure prior to the emission of the first certificate to an entity, demands the receipt of the adhesion agreement to be duly signed by the person in charge of the entity together with the signature of the nominated user of the certificate, whereby the same attest the acceptance and obligation to comply with the general conditions of the emission and use of VORTAL digital certificates.
b) In the previous procedure, with regards to the emission of that certificate to a new user of an entity that has already been accredited, this emission is conditioned by the prior accreditation, acceptance and activation of this user’s registration, by the charged designated user from that entity, on the platform.
4 – VORTAL is responsible for verification referred to in paragraph a) in the previous number, reserving the right to be able to consult other sources who can confirm the data presented and use the services of third parties to that effect, be they public or private, so as to prevent situations of fraud and ensure the security and credibility of the information on the platforms that it manages.
5 – The designated user appointed by the entity will be, in all cases, the sole person responsible for the veracity of the information submitted and signed in the membership agreement, for the accreditation of all other users registered by the entity as well as the permanent updating of information referred to in the previous numbered sections.
6 – All users who register a request for a VORTAL certificate are responsible for the veracity of the information submitted and for guaranteeing the confidentiality of the process for obtaining a digital certificate and respective private key.
7 – If a particular person using the platforms managed by VORTAL represents two or more companies, then in order to be unequivocally recognized in each case, the person should have a digital certificate for each separate company;
8 – Certificates emitted by VORTAL have as their objective the authentication of users to access information with regards to public contracts, made available on the platform.
The submission of proposals, attached files and the exchange of messages between entities requires the use of Qualified Digital Certificates.
9 – The user who was issued the certificate is solely responsible for safeguarding its security, namely ensuring that it is not imparted to third parties, to make a security copy, among other procedures that VORTAL will regularly bring to the user’s attention, and all of the consequences resulting from the certificate's use.
10 – Certificates issued by VORTAL are valid for two years starting from the date of their issuance, it being the entity’s user or the legal representative of the entity responsible for requesting a new certificate before the end of the expiry date of the same.
11 – The user or entity’s legal representative may, at any time throughout the duration of the certificate’s validity period, request that it be revoked.
12 – VORTAL reserves the right to revoke any certificate issued by it, whenever there is evidence of misuse of the same, namely attempts at undue or fraudulent use, being obliged to inform the user and/or the legal representative of the entity to whom the certificate in question was issued.
